Topick is a social content creation platform that helps you create engaging content for social media platforms. Our Service includes:

Other content creation tools

The Service is designed primarily for personal social media use. Users can access basic features to try the Service, with expanded capabilities available through paid plans.

Account Registration and Management

Registration Requirements

You must be at least 13 years old to use the Service
Users aged 13-16 require parental or guardian consent
You must provide accurate and complete registration information
One email address can only register one account

Account Security Responsibility

You are responsible for maintaining the security of your account and password. You are responsible for all activities that occur under your account. If you discover any unauthorized use of your account, you should notify us immediately.

Account Deletion

Attempting to circumvent any technical limitations or access control measures

Content Restrictions

You may not generate or disseminate content that violates local laws and regulations or major social media platform policies. Specific restrictions include but are not limited to:

Pornographic or sexually violent content
Child sexual abuse material
Content promoting violence or hatred
Content infringing on intellectual property rights
Malicious code or viruses
Misleading or deceptive content intended to manipulate others

Intellectual Property

User Input Content Ownership

You retain full ownership of all content you provide to the Service (including text, images, audio, etc.).

Generated Content Ownership

You own all rights to content generated by the Service for you (including text, images, audio, video, etc.). You may freely use, modify, share on social media platforms, and commercialize this content without attribution requirements.

License Granted to Topick

To enable us to operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your input content, solely for the purpose of providing the Service to you. We will not use your content to train our own AI models.

Marketing Use

We may display anonymized use cases in marketing materials. If we wish to use identifiable content, we will obtain your explicit consent in advance.

User Obligations and Warranties

Content Legality Warranty

You warrant that:

You have legal rights to all content you upload or input
Your content does not infringe on any third party's intellectual property, privacy, publicity rights, or other rights
You have the right to authorize us to use your content as per these Terms
The content you generate and use complies with all applicable laws and platform policies

Copyright and Likeness Responsibility

When creating content that references, remixes, or is inspired by existing works or individuals:

You are solely responsible for ensuring you do not infringe on the copyright, trademark, or other intellectual property rights of original creators
You must not create content that falsely implies endorsement by or affiliation with individuals or brands without authorization
You must obtain proper permissions before using others' images, voices, or likenesses
You bear all legal liability if you infringe on others' rights through your use of the Service

We reserve the right to remove suspicious content and ban accounts that repeatedly violate these obligations.

Indemnification

You agree to indemnify and hold harmless Topick and its employees from any claims or demands (including reasonable attorneys' fees) arising from your use of the Service, your generated content, or your violation of these Terms.

Payment and Refunds

Subscription Terms

Access to certain features of the Service may require payment of subscription fees. We offer various subscription plans with different features and usage limits. Specific pricing and plan details are published on our website and may be updated from time to time.

Payment Methods

We process payments through Stripe. You are responsible for keeping your billing information up to date.

Refund Policy

Subscription fees are generally non-refundable, except in the following cases:

Major service failures preventing you from using the Service
Accidental subscription (within 24 hours of purchase and no paid features used)
Other circumstances required by local law

Service Availability and Disclaimers

Topick does not endorse and is not responsible for content created by users. You are solely responsible for how you use generated content, including ensuring it complies with applicable laws and platform policies.

Limitation of Liability

To the fullest extent permitted by law, Topick shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits or revenues
Loss or corruption of data
Any consequences arising from users' use of generated content
Claims by third parties related to content you create or share

Termination and Suspension

Topick's Termination Rights

We may, at our sole discretion, terminate or suspend your account and access to the Service, with or without prior notice, for the following reasons:

Violation of these Terms
Engaging in conduct harmful to other users, us, or third parties
Repeated copyright or intellectual property infringement
Creating content that violates platform policies or laws
Suspected fraud or illegal activity
Extended inactivity (over 12 months)

User's Termination Rights

You may terminate your agreement with us at any time by deleting your account or ceasing to use the Service. After termination, you will lose access to paid features, and paid fees will not be refunded (unless eligible under the refund policy).

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Arbitration Clause

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration conducted under the arbitration rules of the Hong Kong International Arbitration Centre (HKIAC). The place of arbitration shall be Hong Kong, and the language of arbitration shall be English.
